TNI and the Restraining Order against Robert Dean Jr.

U.S. COURT FOR THE DISTRICT OF UTAH CENTRAL DIVISION

Tahitian Noni International vs. Robert L. Dean Jr, Top Gun International, Herschel Gibbs, Bridges International, Donna Allen, Preprospecter Inc, and Noni Matters.

Some highlights of Case No. 2:09-CV-51 TS:

On December 19, 2008, Dean demanded an advance on the Cash Award in the amount of $100,000.00. Plaintiffs complied, depositing the funds into Dean’s bank account. Within a short time of receiving the funds, Dean announced that he was working for and promoting one of Plaintiff’s competitors (the “Competitor”). Dean also began actively soliciting members of his downline to end their relationship with TNI and join the Competitor.

Plaintiff represented to the Court during oral arguments that Dean’s exit will likely reduce Plaintiff’s revenues by approximately 3%.

The Court finds that there is a substantial likelihood of success on the merits, based on Section A.10.B. of the Manual. The Court also finds that Dean’s promotion of a competitor’s product while still employed by Plaintiff is causing irreparable harm to Plaintiff’s goodwill.

The parties represent that the IPC Agreement expires in May 2009, only four months away. The evidence presently before the Court indicates that Dean has taken no actions to terminate the IPC Agreement prematurely, so that his continued work for Plaintiff is entirely his own responsibility. Finally, the Court finds that there are no public policy arguments against issuance of a Preliminary Injunction based solely on Section A.10.B. of the Manual.

It is therefore ORDERED that Plaintiff’s Motion for a Preliminary Injunction is GRANTED in part and DENIED in part. The Injunction is as follows:

  1. During the term of the contract IPC contract between Robert L. Dean, Jr. and Tahitian Noni International, Inc., and for one year thereafter, Robert L. Dean, Jr. and Top Dog International shall not promote or sell any non-Tahitian Noni® brand ingestible or topical products derived from the Morinda citrifolia plant.
  2. Until such time as Robert L. Dean, Jr. ceases to be an IPC for Tahitian Noni International, Inc., Robert L. Dean, Jr. and Top Dog International shall not promote or sell any non-Tahitian Noni® brand liquid dietary supplement without prior written approval from Tahitian Noni International, Inc.
  3. Plaintiff shall post a bond in the amount of $10,000.00. This Preliminary Injunction shall become effective immediately upon posting the bond.

    Rob was the top guy in the company. If he leaves then there must be something wrong. Condemn him if you want but,the other TOPGUN leaders that stayed took lump sum payments from TNI founders to stay ,knowing that their leaders were starving. You tell me where the integrity breach was.Barry Byrd,james Tucker,Tony Fleming,theMyricks all are’nt even paid as Black pearls in a long time.

    For a person that is not ot the top of the compensation plan within a company to say who is and who is not getting paid at a certain level is hearsay. You don’t know the true reason behind why Robert left TNI and it had nothing to do with one company or the other. It was personal. His personal reasons forced him into a decision for his benefit, not anyone on his team, but HIM personally. At the end of the day he has to pay his bills, no one else’s. Not Barry’s, Tony’s, James, Wendy and Javis, not even Donna’s or Herschel’s or Larry’s for that matter. Those that went with him left because of their loyalties to him and not a company. It didn’t matter if he’d a went to Primerica, they would’ve left with him because of loyalty. The integrity of TNI had nothing to do with his decision to leave. No company still to date has paid out more than TNI in a 12 year period nor have they published any compensation plans better than TNI. It was never a question about money as the Network Marketing industry is by no means hurting for money! Get your facts correct before throwing slanderous statements! This site is built for haters of TNI anyway!

    I was on the call when rob shared with the top gun team that he we leaving the company. He said nothing about the company or the complan. all he said was it was time to leave, the 7 year ich as he called it. We all know rob got a large payment for the other company to leave tni-4million to leave.so if a man is living well above his income you start to make money decesion and not business decesion. The sad part about that is he didnt share that with his team. if he share this with the team most of the team would have stay because that would of been the best thing for the reps.

    I really wish that some people on here can be honest for a second. Does it make any logical sense for any of us black folk to follow an obese man that is claiming the importance of the health and wellness industry? I recently saw Mr Dean and his son in a video squeezing into a exotic super car and I almost got sick to my stomach. Umm Mr. Dean, we are dying at an alarming rate of weight related issues in the black community. This movement you claim to be apart of is about more than money. If you really are about helping people, you would want them to FIRST be alive then, build their wealth. Lose some weight you fat slob (that goes for your son as well) By the way, how many white people do we see posing in front of cars? It is usually houses and land for them!!

    You people need to stop making judements about Robert Dean. How many people have you helped $500, $1,000, $10,000 or more each month. None of you know the real reasons why he left. All you’re doing is just voicing your own opinions based on whatever issues you’re having in your lives. He’s a business man and he made a business decision. TNI wasn’t condusive to his goal of creating 500 millionaires, so he went to another company that was. Some people went out of loyalty, some people went because they know Robert Dean is no dummy and if he made a decision to leave a $2million per year income to start all over again, it must be something good about the company.

    Also, it very imature for B Cherry to talk about their weight. That tells alot about your character. So what they are big. He’s promoting a product that’s good for you and a way to make money as well. It’s none of your business how big he is, the question is do you want to be in the financial position he’s in?

    Top dogs leaves companies all the time, just like people leave jobs. It’s their decision to leave if they want to. It’s a shame how people to smiled in Robert Dean’s face, took pictures with him, ate off of his dollar, then when he decides to make a move will benefit the people, not just about him, then people turn on him. I bet everyone who wrote something negative about him here are broke, negative haters. But I guess and opinion is like an ass-hole, everyone’s got on.

    Grow up and get a life. I’m with Robert Dean and I’m going to make that money.

    B Cherry, I see where you are coming from, but everything is based off stereotypes. They pose in front of cars to seemingly attract more black IPC’s (really, “customers”), and cars, boats and land seemingly appeal to more white people. I’m learning more and more that it’s not the people at the top we should be mad at, but rather succumbing to our own human psychology.

    At the end of the day you have to do what is right for you. Robert Dean will probably move from company to company to keep enjoying the lifestyle he has. In addition, in our minds we amplify certain things that we see, that’s why when they show you the checks, the houses, the cars, and they TELL you a story that you have no means of verifying, your mind makes it seem much better than reality. This is why they seemingly prey on those who do not have money or resources, and say things that people want to hear (don’t you want to fire your boss/don’t you want to spend more time with your family?). If you think about it, you can’t “fire” your boss, because you didn’t hire him to begin with, he hired YOU! Also, who really wants to spend MORE time with their family? Why do you think after the holidays people just want their family to LEAVE?? LOL

    The real truth is that The company used Dean and others like him to sell their products AND their MLM business to others, and Dean and others like him used their downline “customers” to maximize their earning potential. “Used” sounds harsh, but that’s what employers do to their employees everyday. Dean and others like him simply learned the game and know how to play it…you have to get into any untapped market early on to be really successful, otherwise you become a pawn in the game (IPC’s). Dean primarily left because the Noni income train was tapping out, and it was time to find another fairly young, untapped MLM company.

    Wash, rinse, repeat.

    WOW!!! It really is amazing at how some people will assasinate another mans charecter based on a bunch of rumors and speculations. I have been with TOPGUN since 2000 and Robert Dean has always put his team first before any amount of money. He has always been focused on making others rich. Do your research before you make judgement on someone. Get the real facts before you start blasting somebody. Personally I think as a race you should give the man credit for trying to make the lives of his people better.
    Robert Dean has been approached by several companies in the past offerring him 10, 15, 50 million just to move his team over, and yes this even included Tahitian Noni. Mr. Dean could have easily taken any of these offers but it wouldnt help his team. To be honest with you those that stayed with TNI are the ones who got paid to stay and keep their teams in a position where they couldnt prosper. I can tell you from inside sources, he never recieved one dime to move his team. Understand at one time TOPGUN was responsible for over 65% of TNI world-wide revenue. When you try to remove that kind of money from a company of course there’s going to be issues. The truth is if you take that kind of revenue from any company it could seriouly destroy that company. This is the reason for the lawsuit. TNI made him and all the top leaders a sizable multi-million dollar offer just to stay and I cant blame TNI one bit. Those who stayed got paid. Those who saw the bigger picture moved on and positioned their team to get paid.
    Understand the business we are in is network marketing. The nature of our business is to take a new company and expose products and services until such time that the company has established a world-wide brand, then we as network marketers move to another company and do the same thing. Anybody that has made millions in network marketing can tell you this. You cant find someone whos actually made millions in MLM that hasnt been in at least 10 different companies.
    OK Mr “Lets Keep It Real” I want to say to you get your facts straight! Robert Dean never took any money from any company to leave, ask your leaders who stayed with TNI to break bread with you cause thats who really got paid. And “B Cherry” I wish I was Robert Dean right now I would slap you across your ignorant forehead with a stack of hundreds for being so dumb. You make black people look bad. Truth be told you probably as fat, broke, bad bodied, and ugly as your blog. Get a life and stop worrying about the next man.
    Say what you want about the man but as “Xaiver SAB” said when its all said and done, How many people have you helped become millionaires? Look put the B.S. behind you and pour out that super sized cup of HATER-AID. When you get tired of companies changing comp plans and draining your bank account every month for an autoship that aint making you rich, hit me up.

    I love me some Robert Dean, Jr.
    I am a person that needs the product, but buisness-wise, whatever Robert does, I am in, and he’s a man that knows how to make money. I do not care why he left. Robert is a thinker, a philosopher, and a man that know where the money is at. He’s the most generous person you will ever meet. Mr. Dean is not just about how he can become rich; he is about how to make others as successful as he. Money does not define him; he defines money. You will watch others sit by the wayside and talk about things that do not matter, and if you ask them: “How many people have you helped to get money out of the way in life?”, they have nothing to say, but continue to find flaws in the ones that do help others in life. You see, if I saw a picture with someone getting out of a sports car, I would have been looking at how I can GET that car, instead of looking at what someone looks like. That is the differnce in the ‘poverty mindset’ and the ‘millionaire mindset’. There are three types of people in this world: those who MAKE things happen, those who WATCH things happen, and those that didn’t even know WHAT happened.People are intitle to their opinions and beliefs of what they think on life and on others thats the beauty of the society we live in.

    I was a IPC for TNI a while back. what i learned was that if you don’t get in the groundfloor you will be a slave making someone else money. If someone ask you to get a business with them ask a important question how long and how much money they have made. I they be double talking just say no thanks. I was on Robert Dean’s team and the one I notice is he didn’t realize that the white man wasn;t going to let him get larger than them, that’s just the it is.

    I really don’t know what happened to TNI and Robert Dean, Jr. Rob loved TNI and TNI loved Rob. It hurt me when I found out the DEVIL was doing what he do. Killing, Stilling and Destroying. I don’t know what went wrong but we need to get things together and forgive one another. We are living in the last days. Rob loved the company so well that he inspired me and ohters to join the company. We really need to hear what really happened and correct this problem and make sure it doesn’t happen again. Nobody’s perfect we all strive for perfection. It’s simple as that. I would love Rob to come back, we need him. There is enough money and Noni for everyone. Don’t you all see, God created it all and we are fighting like dogs. We are more and better than that. We are SONS OF GOD. What ever happen to Man in the Mirror. Have we forgotten that all of us need to look in the Mirror at yourself. Then throw the stone. May GOD Bless All of you…real good. We are his children. This is sad but I’m praying that something good will come out of this. A seed has been sown. Let’s reap a good harvest.
